Terms of Service

01 Acceptance of Terms

These Terms of Service ("Terms") apply equally to Guesthouse Butler, Guesthouse Breakfast and Guesthouse Assets (collectively, the "Guesthouse Mobile Applications" or the "Applications"), each developed and provided by eMviasoft Ltd ("we", "us", or "our"). By downloading, installing, registering a local account in, purchasing a subscription for, or using any Application, you agree to be legally bound by these Terms. No one Application is the primary application under these Terms; unless a provision expressly states otherwise, every provision applies separately and equally to each Application.

02 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the applicable Guesthouse Mobile Application. By using the applicable Guesthouse Mobile Application you represent and warrant that:

• You have the legal capacity to enter into a binding contract.
• All information you provide is accurate and complete.
• You will use the applicable Guesthouse Mobile Application in accordance with these Terms and applicable laws.

03 Description of the Service

Guesthouse Butler, Guesthouse Breakfast and Guesthouse Assets are separate mobile applications within an integrated Guesthouse suite intended to assist users with guesthouse and short-term rental operations. Depending on the particular Application, available functionality may include property and guest information, reservations, breakfast-related operations, assets, stock and consumables, cleaning or maintenance activities, expenses, reminders, and related operational records. The exact functionality available in each Application is determined by that Application and its current version.

Each Application stores the operational data entered through that Application locally on the user's device. The Applications may use the same local database on that device to provide integrated functionality and consistent data. We do not provide cloud synchronization, online backup, or shared access between devices unless explicitly introduced as a feature in a future update. Limited analytics data may be processed through Firebase Analytics as described in the Privacy Policy.

Information entered or generated in one Application may be available to another of the Applications installed on the same device where necessary for integrated functionality. The common database remains local to the device and, by itself, does not upload property, guest, reservation, breakfast, asset, stock, inventory, expense, or other operational data to eMviasoft Ltd servers.

Each Application is licensed and subscribed to separately. A subscription for one Application does not unlock, activate, license, or include a subscription to either of the other Applications. The same subscription prices and conditions may be offered for each Application, but every purchase applies only to the Application for which it was made.

Guesthouse Breakfast may offer an optional feature allowing users to download selected popular recipes from around the world for local use. Recipe content is downloaded to the device. This feature does not provide cloud storage, synchronization, backup, or server-side storage of the user's own recipes, operational information, or other locally created data on eMviasoft Ltd servers.

04 User Accounts

To use the applicable Guesthouse Mobile Application, you must create a local account on your device. You are responsible for:

• Maintaining the confidentiality of your password.
• All activities conducted through your account.
• Immediately notifying us of any unauthorized use of your account.

Since accounts are stored locally on your device, we cannot recover lost passwords or data on your behalf.

05 Subscription Plans and Pricing

Each Application requires its own separate subscription. A subscription purchased for Guesthouse Butler applies only to Guesthouse Butler; a subscription purchased for Guesthouse Breakfast applies only to Guesthouse Breakfast; and a subscription purchased for Guesthouse Assets applies only to Guesthouse Assets. A subscription for one Application does not unlock, license, or provide paid access to either of the other Applications. Each Application offers the same standard subscription options: 3 months for EUR 4.99 and 1 year for EUR 14.99, subject to the final price and applicable taxes displayed by the relevant app store at the time of purchase.

Access to certain features of the applicable Guesthouse Mobile Application is provided through paid subscription plans. The available plans are:

5.1 Pricing

• Prices are listed in Euros (EUR) and exclude Value Added Tax (VAT) where applicable. VAT will be added at the rate required by your country of residence and shown at the time of purchase.
• We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price change takes effect, in accordance with Apple App Store and Google Play Store policies.

5.2 Payment Processing

All subscription payments are processed through:

• Apple App Store (for iOS users)
• Google Play Store (for Android users)

You authorize the relevant app store to charge the payment method associated with your account. We do not collect or store your payment card details.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each applicable billing period (three-month or annual) unless cancelled in accordance with the rules of the relevant app store before renewal. The renewal amount will be charged to your account through the relevant app store.

5.4 Cancellation

You may cancel your subscription at any time through your device settings:

• iOS: Settings → [Your Name] → Subscriptions → [applicable Application]
• Android: Google Play Store → Menu → Subscriptions → [applicable Application]

Cancellation takes effect at the end of the current billing period. You retain access to premium features until that time.

5.5 Refunds

Refunds are subject to the policies of the relevant app store:

5.6 Free Trial for New Users

Each of Guesthouse Butler, Guesthouse Breakfast and Guesthouse Assets offers its own 3-day free trial, subject to eligibility determined by the applicable Application. The free trial applies separately to each Application, requires no payment, does not automatically convert into a paid subscription, and does not result in an automatic charge. After the trial expires, continued access to paid features in that Application requires a separate subscription for that Application.

New users of each Application may start a one-time free trial of 3 (three) days that provides full access to all premium features. The free trial works as follows:

• No payment method or purchase is required to start the free trial, and no payment is taken during the trial period.
• During the trial, the user has full access to all premium features.
• The free trial does not automatically convert into a paid subscription and will not result in any automatic charge.
• At the end of the 3 (three) day period, continued access to premium features requires purchasing a Three-Month or Annual subscription for the applicable Application.

Eligibility: The free trial is offered once per user, regardless of whether the user would later select the three-month or annual plan. Trial availability is determined by the applicable Guesthouse Mobile Application.

Implementation: The free trial is managed internally within the applicable Guesthouse Mobile Application and grants temporary access without any app store transaction. If you choose to subscribe during or after the trial, the standard subscription, payment, auto-renewal and cancellation terms set out above apply from the moment of purchase.

06 Acceptable Use

You agree not to:

• Use the applicable Guesthouse Mobile Application for any unlawful purpose or in violation of any applicable laws or regulations.
• Reverse engineer, decompile, or attempt to extract the source code of the applicable Guesthouse Mobile Application.
• Use the applicable Guesthouse Mobile Application to store or process data that infringes the rights of third parties.
• Use automated systems or scripts to access or use the applicable Guesthouse Mobile Application.
• Resell, sublicense, or transfer your subscription to another party.
• Attempt to bypass payment requirements or security measures.

07 Your Responsibility for Data

Since operational data is stored locally on your device and may be held in the shared local Guesthouse database:

• You are responsible for protecting and, where supported by your device, backing up locally stored data. Any device-level backup service is provided by the relevant operating-system or backup provider and is outside eMviasoft Ltd's control.
• We are not liable for any loss of data caused by device failure, theft, loss, uninstallation, or any other reason. Because the Guesthouse Mobile Applications may use a common local database, uninstalling only one application may not remove data that remains in use by another installed Guesthouse Mobile Application.
• You must comply with all applicable data protection laws (including GDPR) when entering guest information into the applicable Guesthouse Mobile Application.
• Where information entered into an Application relates to guests or other third parties, you are responsible for having an appropriate lawful basis for processing that information under applicable data protection law.

08 Intellectual Property

The applicable Application, including all content, design, code, logos, and trademarks, is the exclusive property of eMviasoft Ltd and is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the applicable Guesthouse Mobile Application for personal or business use in accordance with these Terms. You are not granted any other rights to the applicable Guesthouse Mobile Application.

Data you enter into the applicable Guesthouse Mobile Application remains your property. We make no claim of ownership over your data.

09 Third-Party Services

The applicable Application relies on the following third-party services. Your use of these services is subject to their respective terms and privacy policies:

• apple.com/legal/internet-services/itunes
• play.google.com/about/play-terms
• Google Firebase Analytics — used to collect limited analytics data, including a Firebase App Instance ID (not linked by us to the user) and Product Interaction data, solely for analytics purposes.

Further information about the categories, purposes, legal basis, retention, and handling of analytics data is provided in the Privacy Policy, which forms part of these Terms.

10 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

• The applicable Application will be uninterrupted, secure, or error-free.
• The applicable Application will meet your specific requirements.
• Any defects will be corrected.
• Calculations or reports generated by the applicable Guesthouse Mobile Application are suitable for tax, accounting, or legal purposes. You should consult a qualified professional for such matters.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, eMviasoft Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use or inability to use the applicable Guesthouse Mobile Application.

Our total cumulative liability to you for any claims arising from or related to the applicable Guesthouse Mobile Application or these Terms shall not exceed the total amount you paid to us for subscriptions in the 12 months preceding the event giving rise to the liability.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under applicable law.

12 Indemnification

You agree to indemnify and hold eMviasoft Ltd harmless from any claims, damages, or expenses (including legal fees) arising from your use of the applicable Guesthouse Mobile Application, your violation of these Terms, or your violation of any rights of a third party (including data protection violations regarding guest data).

13 Termination

We may suspend or terminate your access to the applicable Guesthouse Mobile Application at any time, with or without notice, if you violate these Terms.

You may stop using the applicable Guesthouse Mobile Application at any time by uninstalling it. Cancellation of your paid subscription does not automatically delete local data. Because each Application may share a local database with Guesthouse Breakfast and Guesthouse Assets, uninstalling Guesthouse Butler alone may not delete shared data while another Guesthouse application remains installed. Local data should be removed using the available in-app or device-level controls, or by removing the Guesthouse applications and their shared local data as supported by your operating system.

14 Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated through the applicable Guesthouse Mobile Application or through the relevant app store. Continued use of the applicable Guesthouse Mobile Application after changes take effect constitutes acceptance of the modified Terms.

15 Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the applicable Guesthouse Mobile Application shall be subject to the exclusive jurisdiction of the courts of Sofia, Bulgaria.

17 Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and eMviasoft Ltd regarding the applicable Guesthouse Mobile Application.
• No Waiver: Failure to enforce any provision does not waive our right to enforce it later.
• Assignment: You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.
